Terms of Service

These Terms govern your use of the BookPromo Engine service (the "Service"), operated by Book Promo Engine (the "Seller", "we", "us"). By accessing or using the Service you agree to these Terms.

1. The Service

The Service generates marketing assets (metadata, ad copy, cover variants) for self-published books based on inputs you provide.

2. Accounts

You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. You must be of legal age in your jurisdiction.

3. Acceptable Use

You may not: (a) use the Service unlawfully; (b) infringe third-party intellectual property or impersonate creators; (c) attempt to interfere with, probe, scrape, reverse engineer, or circumvent technical limits of the Service; (d) introduce malware; or (e) violate any marketplace or ad-network policy with content generated through the Service.

4. Intellectual Property

The Service, including its software, models, documentation, and branding, is owned by Book Promo Engine and its licensors. You receive a limited, non-exclusive, non-transferable right to use the Service within your plan.

5. User Content

You retain ownership of files you upload. You grant us a limited license to host and process them solely to deliver your requested output.

6. Payments, Billing, and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

All payment, billing, currency, tax, cancellation, and subscription mechanics are governed by Paddle's Checkout / Buyer Terms. Subscriptions renew automatically at the end of each billing period until cancelled.

7. Refunds

We offer a 30-day money-back guarantee on purchases. To request a refund, visit paddle.net or contact us via the Contact form. Refunds are processed by Paddle in accordance with the Paddle Refund Policy. See our Refund Policy for full details.

8. No Guarantee of Results

The Service provides recommendations based on historical data. We make no warranty regarding sales performance, ad approval, listing rank, account standing, or any commercial outcome.

9. Warranties Disclaimer

To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid for the Service in the prior 12 months. We exclude liability for indirect, consequential, incidental, or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where such exclusion is prohibited by law.

11. Indemnity

You agree to indemnify Book Promo Engine against claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

12. Suspension & Termination

We may suspend or terminate access for material breach, non-payment, security or fraud risk, or repeated policy violations. On termination, your right to use the Service ends; you may export your projects during a 30-day grace period before deletion.

13. Changes

We may update these Terms at any time. Continued use after changes take effect constitutes acceptance.

14. Governing Law

These Terms are governed by the laws of the seller's jurisdiction, without regard to conflict-of-law principles.
